In this fifth episode of Star Trek Captain Kirk is ordered to Sedona for retraining. A retraining order is a shocking development for an experienced e-discovery captain like Kirk. This is more fall out from the takeover of Starfleet command by the Sedona Conference, which was the premise behind Star Trek Meets e-Discovery: Episode One – Captain Kirk is Ordered into the Neutral Zone.
Apparently Captain Kirk’s record was studied by the senior admirals, and even though he has never failed in a mission, never lost a case, they concluded that his successes often came at too a high price. Just ask the poor red shirt ensigns (today we would call them contract lawyers), not to mention the clients who pay for Kirk’s constant red alert, over-kill tactics. Starfleet Command is critical of Captain Kirk’s failure to follow the second of the fourteen Sedona Principles. That is why Captain Kirk is ordered for retraining. He needs to modify his over-zealous leadership to comply with principle two.
Captain Kirk travels to the planet Sedona. As usual, Spock objects to the retraining order as illogical, but Kirk tries anyway. He is beamed down to the retraining center where he is taught by Admiral Braman himself. He learns all about Principle Two, the proportionality principle, in classic Sedona dialogue fashion, and all ends well.
Hopefully this cartoon will inspire you to study-up on Seonda Principle Two too. Even if you are an experienced captain of an e-discovery enterprise, a little retraining now and then is a good thing. That is one reason I started e-Discovery Team Training, it is for novices and pros alike, and its 84 classes go deep into Sedona Conference ideas. Many of you did not get that training in law school. In addition to my school, go direct to the source, and check out the Sedona paper on proportionality, The Sedona Conference® Commentary on Proportionality in Electronic Discovery, available for free downloading at www.thesedonaconference.org. Your crew and clients will be glad you did.
Great analogy; and I love the British Spock, haha!
